Article 1. Preamble .
These conditions are concluded between, on the one hand, Lëtz SA, a public limited company incorporated under Luxembourg law, located at Zone industrielle, 5, in L-8821 Riesenhaff (Luxembourg), hereinafter referred to as "letz.coffee" under the commercial name and, on the other hand, natural persons wishing to make a purchase via the letz.coffee website http://www.letz.coffee hereinafter referred to as "the user".

1.2 General information
The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any conditions previously available on the site. If a condition were to be missing, it would be considered to be governed by the customs in force in the distance selling sector for which the companies are headquartered in Luxembourg. The non-application of one or more provisions of these conditions can never be considered by the customer/buyer as a waiver of these conditions. These conditions aim to define the terms of sale between letz.coffee and the user, from the order to delivery, including payment. They regulate all the steps necessary for placing the order and ensure the tracking of this order between the contracting parties. Any user of the site who does not have a customer number must follow a registration procedure allowing them to subsequently obtain their customer number. In all cases, the final validation of the order implies the acceptance of it, in its entirety and at the indicated price, by the user. This validation constitutes signature and express acceptance of all operations carried out on the site.
Article 2. Terminology .
The services offered by letz.coffee on its website, namely the sale of products, will hereinafter be referred to as the “letz.coffee services”, each person wishing to benefit from the services of letz.coffee and having satisfied the general conditions of sale will hereinafter be referred to as a “customer”, each company having mandated letz.coffee to sell a product belonging to it on its site will be referred to as a “supplier”, each order placed by a customer under the conditions provided will hereinafter be referred to as “the order”.
Article 3. Recording of personal data .
Any natural or legal person who registers while visiting the website "http://www.letz.coffee" as a potential contracting party of letz.coffee communicates his or her personal data to letz.coffee through his or her registration. Registration implies explicit consent that his or her identification data may be processed in the letz.coffee data file. Only legal or natural persons with full legal capacity may register. During the registration process, the natural or legal person receives an ID number and chooses a password that is validated by letz.coffee and this information is confirmed by sending a summary email by letz.coffee to the customer. The customer is responsible for the confidentiality, security and actual use of his or her ID and password. Any use of a certain customer's ID and password is assumed to have been made by that customer. letz.coffee may temporarily or permanently disable the use of the username and password if it appears that the customer is in breach of one or more provisions of these general terms and conditions. The controller of the customer's personal data is: "letz.coffee" contact@letz.coffee The processing of this personal data in the letz.coffee data file takes place for the purposes of customer administration, order management, deliveries, invoicing of tangible and intangible services, solvency monitoring, advertising through the profile, personalized treatment and marketing.
Article 4. Protection of privacy .
Principles relating to the collection of personal data. In principle, access to the information available on or via the site is possible without having to provide personal data, such as name, postal address, email address, etc. Exceptionally, in order to obtain additional services (request for information, reservation, member area, subscription to a newsletter, etc.), it is possible that personal information, mainly contact details, may be requested from the user. In this case, the user is notified in advance and the data is processed in accordance with the provisions of Directive 2002/58/EC relating to the processing of personal data. In concrete terms, this means in particular that: - your personal data may only be collected and processed in accordance with the purposes indicated at the time of their collection; - you have the right to access and rectify this data at any time, as well as the right to object, in order to verify its accuracy and to correct any errors concerning it. To do this, please send us an email to contact@letz.coffee, clearly stating your contact details. Use of browsing information for statistical purposes. When you access the site, the servers consulted automatically collect the following data: the IP address assigned to you when you connect; the date and time of access to the site; the pages consulted; the type of browser used; the platform and/or operating system installed on the PC; the search engine and keywords used to find the site. This information is only kept for the sole purpose of measuring the number of visitors to the different sections of the site and making improvements. Use of cookies. In order to facilitate your navigation on the site and to optimize technical management, letz.coffee may occasionally use "cookies". A "cookie" is a small piece of information saved by a website in your computer's Internet browser. This cookie can be retrieved during a subsequent visit to this same site. The cookie cannot be read by any website other than the one that created it. The site uses cookies for administrative purposes, for example, to record your preferences for certain types of information, which will save you from having to repeat the same keyboard entries each time you visit our site. Most cookies only work for the duration of a session or visit. None of them contain information that would make you likely to be contacted by telephone, email, or post. You can also configure your browser to inform you each time a cookie is created or to prevent them from being recorded.
Article 5. Price terms .
All product information and prices are listed on the corresponding product description sheet. The sales price of each product presented on the letz.coffee website is expressed in euros. This price includes VAT (where applicable), excluding any delivery charges (see ART. 6 of the Terms of Sale). The price paid by the buyer, hereinafter referred to as the total price, is also explicitly stated as such when the order is placed. For any questions regarding pricing terms, the customer simply needs to send an email to contact@letz.coffee.

Current rates: All orders placed on the letz.coffee website will be delivered by DPD or XPRESS LOGISTICS , depending on the destination. In the case of a returned package, the costs will be borne by the customer (see ART. 10 of the terms and conditions of sale).
Delivery times:
Delivery times generally vary between 48 and 72 hours for Europe. If the package is not collected within this timeframe, it will be automatically returned to the seller by the carrier. At the customer's request, a new shipment may be scheduled at their expense, or the order may be refunded, less the delivery costs.
Packaging and insurance:
Your purchases are packaged with the utmost care, using protective materials. The attention we pay to packaging allows us to offer delivery in the best conditions. Shipped products are insured against deterioration and theft throughout the transport period. You must therefore ensure the integrity of your order and all the items it contains upon receipt of the package and in the presence of the person making the delivery in order to issue a reservation if necessary. In the event that you have any doubt about the condition or contents of the order, you are required to refuse the merchandise upon receipt. Any refused product must be returned to the carrier in its entirety and in its original packaging.
In case of absence
Depending on the carrier, a delivery notice will be left in your mailbox. The first time, a phone number will be provided to allow you to schedule a new delivery time. If, unfortunately, the second attempt fails, the package will be automatically returned to our company.
Refusal of delivery and return of unclaimed parcels
In the event of refusal of delivery or return of an unclaimed package, the customer will be reimbursed for the amount of their order less the return costs borne by Letz SA.
Possible loss of package
Despite our automated tracking of shipments, it is very rare that a package may be lost. In this case, we invite you to contact our customer service by email: contact@letz.coffee
The following cases of force majeure in particular release letz.coffee from its delivery obligation: war, revolt, fire, strikes, accident and the impossibility of being supplied itself by normal suppliers or carriers.
In particular, in the following cases, letz.coffee may temporarily suspend delivery: internal network disruptions, telephone disruptions, disruptions to (problematic) internet access and similar. Performance of the contract shall then be suspended until the disruption is remedied and/or internet access is restored, without the buyer being able to invoke dissolution of the contract and/or compensation.

Article 7. Ordering terms.
The order is placed by the customer with letz.coffee via the website. The order can only be registered on the website if the user has clearly identified themselves either:
- by entering his customer number which is strictly personal.
- either by completing the online order form allowing them to obtain the allocation of a customer number which will be sent to them by the Customer Relations Department following their first order.
Any order implies acceptance of the prices and description of the products available for sale. (See ART.5 of the conditions of sale). By placing an order online, the customer explicitly indicates that they wish to enter into a sales contract with letz.coffee and agree to these general conditions. The customer is informed of the confirmation of this order by e-mail, hereinafter referred to as the 'confirmation e-mail', which summarizes the terms of the order. letz.coffee undertakes to honor orders received on the website only within the limits of available stocks of the products. In the event of unavailability of the product, letz.coffee undertakes to inform the customer as soon as possible. The sales contract between letz.coffee, on the one hand, and the customer, on the other hand, therefore comes into existence at the time of acceptance of the order by letz.coffee.
Article 8. Payment terms.
In order to process orders as quickly as possible and to offer the best service, letz.coffee invites the customer to pay the purchase price at the time of placing the order. In the event of cancellation of the order (See ART.10 of the conditions of sale), letz.coffee is required to reimburse the sums paid by the customer, without compensation, the cost of returning the package being borne by the customer (See ART.10 of the conditions of sale). The purchase price is paid when ordering via the Paypal server https://www.paypal.com - (See ART.9 of the conditions of sale) which letz.coffee uses so that the customer's bank details are encrypted and then transmitted securely:
- Either by indicating the type of payment card (Visa, Eurocard, Mastercard), the payment card number, its expiry date and its possible visual cryptogram by the explicit order to debit the account of the payment card holder;
- Either via Home Banking (ING Home'Pay, Dexia NetBanking and Dexia Direct Net, KBC Online and CBC Online).
- Either by Bancontact / Mistercash for customers of FORTIS, DEXIA, ING and VDK Spaarbank banks.
Authorization: The money is reserved-blocked in the buyer's account, waiting to be transferred to the merchant's account in a second step (data capture) or to be released when the authorization is canceled. NB: Deferred payment and authorization followed by "data capture" are only possible for credit card payments. For any questions regarding payment terms, the customer simply send an email to contact@letz.coffee.
Article 9. Security of electronic funds transfers (EFT).
Transaction procedures on the letz.coffee merchant site are carried out with the highly secure payment service provider: Paypal - https://www.paypal.com. As an expert in payment security, Paypal guarantees that sensitive data is transmitted and stored according to the highest security and quality standards. How it works:
- The customer logs into the letz.coffee website, selects items and places them in their "shopping cart" and expresses their willingness to place the order.
- The customer, after registering, enters their delivery and billing details. The total amount of the order, including all taxes, and the shipping costs are shown.
- After receiving a complete summary of their order, the customer confirms their wish to proceed to the payment stage.
- The customer is seamlessly redirected to the Paypal website, where they enter their payment details (payment method, home banking, credit card number, etc.)
- Payment is requested from the relevant financial institution.
- The customer receives the result of the transaction which he can print and keep as authentic proof.
- letz.coffee performs automated post-sales processing and sends the package to the customer. When it's time to enter the payment parameters (step 4), the customer is automatically redirected to the PayPal website. The exchange of sensitive information—such as the credit card number—is therefore between the customer and the PayPal website; letz.coffee has no knowledge of it. Not only does this mechanism preserve the confidentiality of the information vis-à-vis letz.coffee, but it also allows for the incorporation of new payment methods without requiring any changes to the merchant's website programming.
Furthermore, all transaction costs (commissions from various financial institutions) are fully covered by letz.coffee. At the end of the payment process, control is returned to the merchant's site so that it can perform the "after-sales" processing of its choice (stock updates, the ability to download an intangible asset, etc.). This system therefore offers all the advantages for payments on the letz.coffee merchant site:
- Confidential information is protected using SSL or SET technologies. Therefore, no such information is transmitted in clear text over the network.
- Ensure the confidentiality of payment data (including credit card numbers).
- The merchant or the merchant's website applications do not have knowledge of the buyer's credit card number.
- All communication between the customer's browser and PayPal e-Commerce is done using 128-bit SSL encryption. It is not possible for the customer to use a browser that does not support this encryption technique. PayPal e-Commerce has a certificate issued by Verisign.
- Paypal e-commerce is protected by various firewall systems and protocol conversions to prevent unwanted visitors from accessing data or payment processors.
- Adherence via Paypal to anti-fraud detection protocols
Article 10. Right of withdrawal.
The buyer has 14 days from receipt of their order to inform letz.coffee of their decision to withdraw. They then have 14 days following notification of their decision to withdraw to return their product, at their own expense.
letz.coffee will only honor the buyer's waiver if the original packaging of the product remains intact, including the seal and the product itself, which have not been used or damaged. The buyer must be notified by email (contact@letz.coffee). Upon this occasion, and provided the buyer has respected the deadline described in the paragraph above, they will be issued a return authorization number. In the case of a returned package, and after notifying letz.coffee by email within the deadlines described above, the cost of returning the package is always the customer's responsibility. The customer will be asked to protect the returned items with the utmost care. To make your life easier when returning an item, letz.coffee offers to refund you by transfer to your bank account. To benefit from this convenient, secure, and fast service, simply enter your bank account number on the shipping slip that accompanies the returned items. We will make the transfer as soon as possible (maximum 30 days) after letz.coffee has actually become aware of the withdrawal request and after the products have been returned to letz.coffee. Shipping costs are not refunded. In the event of improper returns, letz.coffee reserves the right to refuse a subsequent order. For any questions regarding withdrawal procedures, the customer can simply send an email to contact@letz.coffee.

Article 11. Applicable guarantees.
Non-perishable products are guaranteed by their manufacturers for the duration and according to the terms indicated in the product description appearing on the warranty certificate attached to the products upon delivery and in the product description appearing on the letz.coffee website.
In the event of a defective product, the customer must return it at their own expense and responsibility, and must arrange transport insurance . The warranty for defective products is subject to full payment of the price by the customer. Malfunctions caused by improper use of the product or by an external cause (such as an electrical surge, in particular) cannot be covered by the warranty.
The provisions of this article shall not deprive the consumer of the legal guarantee of conformity.
When the customer acts under the legal guarantee of conformity, he benefits from a period of 2 years from delivery to report the lack of conformity.
Non-conformity within the first 6 months following delivery
When a lack of conformity appears during the first 6 months following delivery of the item, the item is guaranteed because the defect is presumed to exist at the time of delivery.
The customer then simply has to report the defect from letz.coffee (by phone, email, registered mail, etc.).
In the event of a defect due to misuse by the customer, the product is not guaranteed. It is then up to letz.coffee to prove it.
When the goods do not conform to the sales contract at the time of delivery, the customer in principle has the choice between
- return the goods and receive a full refund, unless the lack of conformity is minor OR if etz.coffee repairs or exchanges the goods;
- keep the item for a reduced price, UNLESS letz.coffee repairs or exchanges the item;
- demand the repair or exchange of the goods, EXCEPT if the repair or exchange is impossible or if it generates disproportionate costs for letz.coffee .
Lack of conformity from the 6th to the 24th month following delivery
When a fault appears between the 6th and the 24th months following delivery of the item, the item is guaranteed if the defect already existed at the time of delivery.
The buyer must then prove that the defect existed at the time of delivery. In general, he provides this proof by an expert appraisal, at his own expense.
Exclusion of warranties:
The following are excluded from the guarantees:
- the breakage;
- normal wear parts such as seals, filters, cartridges, hoses, grids, etc.;
- breakdowns related to accessories;
- failures due to corrosion or oxidation;
- damage caused by external causes (flooding, lightning, storm, etc.);
- breakdowns, damages, failures, defects due to insufficient maintenance or the intervention of a person other than a technician approved by the brand;
- defects and their consequences linked to improper use (it is essential to read the user manual and in particular the instructions for commissioning);
- makeshift or temporary repairs;
- premature wear due to use exceeding the manufacturer's recommendation or for professional purposes;
- poor assessment of the technical characteristics and description of the product;
- the use of a product other than that originally intended by the manufacturer.
Article 12. Liability
The company letz.coffee has only an obligation of means for all stages of access to the site, the ordering process, delivery or subsequent services.
letz.coffee cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including a breakdown in service, external intrusion or the presence of computer viruses, or any event deemed force majeure, in accordance with case law.
letz.coffee cannot be held liable for damages of any kind, whether material, immaterial or physical, which may result from malfunction or misuse of the products sold. The same applies to any modifications to the products resulting from suppliers. The liability of letz.coffee will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.
letz.coffee cannot be held liable to a customer or a third party for any indirect damage, loss of business, profit or turnover, arising in any way whatsoever.
Without limiting the preceding paragraphs, letz.coffee's liability under these terms and conditions may not exceed an amount equal to the amounts paid or payable in the transaction giving rise to such liability, regardless of the cause or form of the action in question.
letz.coffee cannot be held responsible for non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire.
letz.coffee undertakes not to disclose to third parties the information communicated by customers on the site. This information is confidential. It will only be used by its internal services to process your order and to strengthen and personalize communication, particularly through newsletters/emails, as well as to personalize the site based on users' observed preferences. letz.coffee may provide consolidated statistics relating to its customers, sales, trading patterns, and information on the site to trusted third parties, but these statistics will not contain any personal data.
letz.coffee therefore does not sell, market, or rent customer information to third parties.

Legal Information - Conditions of Use of the Site Use of the letz.coffee website is subject to compliance with the general conditions described above. By accessing this site, you declare that you have read and accepted, without reservation, these general conditions of use.
Quality of information and service, limitation of liability Hyperlinks on the letz.coffee portal site directing users to other websites do not engage letz.coffee's responsibility for the content of these sites. The customer will comply with their terms of use.
Intellectual property rights The texts, layouts, illustrations and other elements constituting the site are protected by copyright or, in the case of databases, by a specific right. However, any reproduction of this information for commercial or advertising purposes, as well as all forms of use and reproduction of the other constituent elements of the site, such as the graphic line, images, sounds or computer applications, are strictly prohibited without prior authorization. Creation of hyperlinks to the site letz.coffee authorizes the creation without prior request of surface links that refer to the home page of the portal site or to any other page in its entirety. However, the use of any techniques aimed at including all or part of the portal site in a website by masking even partially the exact origin of the information or which could lead to confusion about the origin of the information, such as framing or in-lining, requires the written authorization of letz.coffee. Information transmitted Do not transmit any unlawful, threatening, defamatory, obscene, scandalous, inflammatory, pornographic or profane information, or any other information that could give rise to civil or criminal liability under the law of the Territory to which this Site refers.
Article 14. Entirety
In the event that one of the clauses of this contract is null and void due to a change in legislation, regulation or by a court decision, this shall in no way affect the validity and compliance with these general terms and conditions of sale.
Article 15. Duration
These conditions apply for the entire duration of the online availability of the services offered by letz.coffee.
Article 16. Proof
The computerized records, stored in the computer systems of letz.coffee and its partners under reasonable security conditions, will be considered as proof of communications, orders, and payments between the parties. The conditions listed on this site apply to deliveries within Belgium and Luxembourg exclusively. The items sold by letz.coffee conform to the description and presentations given in the catalog. Despite all our precautions, errors may have crept into this catalog. Under no circumstances can we be held liable for this.
Article 17. Storage and archiving of transactions
The archiving of purchase orders and invoices is carried out on a reliable and durable medium, so as to correspond to a faithful and durable copy.
Article 18. Applicable law and jurisdiction
These terms and conditions are subject to Luxembourg law. In the event of a dispute, the customer should contact letz.coffee first to seek an amicable solution. Failing this, only the courts of the judicial district of Luxembourg shall have jurisdiction, regardless of the delivery location and payment methods accepted.
